Introduction

“I walked in his office and while he [Mark Cuban ] greeted me at the door, he just looked broken. I mean, he looked as if he had been crying. He was disturbed by it all and just said, ‘I need you.’ Literally the mandate was, ‘I need you to come in and transform the culture,” recalled Cynthia Marshall (Marshall) (She), CEO of Dallas Mavericks (Mavericks), an American professional basketball franchise, in the National Basketball Association (NBA). Marshall was living in Dallas and enjoying retirement after a 36-year-long career at telecommunications giant AT&T when Cuban (He), owner of Mavericks, cold-called her for help. The Mavericks plunged into a crisis after an American sports magazine, Sports Illustrated (SI), published an article in February 2018 exposing a corrosive workplace culture within the business side of the franchise and uncovered numerous instances of sexual harassment and other improper workplace conduct over a period of two decades. Some former and existing women employees alleged that a corporate culture rife with misogyny, predatory sexual behavior, and sexual harassment had been allowed to thrive under the leadership of former President & CEO of Mavericks, Terdema Ussery (Ussery) (He).
